General Terms and Conditions of Sale

1. Role of BF4 Gallery

BF4 Gallery is a direct seller of fine art. Unlike marketplaces that facilitate transactions between third-party buyers and sellers, the items listed on our Services are offered directly by us, or we are acting as the exclusive authorized agent for the artist or owner.

2. Using Our Services

To use our Services, you agree that you:

• Are at least 18 years old and have the legal capacity to enter into binding contracts.
• Will comply with all applicable laws, rules, and regulations.
• Will not use our Services for any illegal or unauthorized purpose.
• Will not attempt to breach, disable, or circumvent any security measures of our Services.
• Will not use any automated means (like bots or scrapers) to access our Services without our permission.

3. Content and Intellectual Property

All content on our Services, including images, text, designs, and logos, is owned by BF4 Gallery or our licensors and is protected by copyright and other intellectual property laws. You make access and view content solely for your personal, non-commercial use. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

4. Purchases and Payments

4.1. Pricing and Availability

All prices are listed in Euros (€) unless otherwise specified. We try to ensure accuracy, but errors may occur. We reserve the right to correct any pricing errors and to change prices at any time without notice. All items are subject to availability.

4.2. Payment Methods

We accept payment by credit card, bank transfer, and other methods as indicated on our website. You agree to provide valid and current payment information. By submitting an order, you authorize us to charge the total purchase price, including applicable taxes and shipping fees, to your designated payment method.

4.3. Taxes

All prices displayed on the website include Spanish VAT (21%) where applicable for sales within the European Union.

For international buyers outside the EU, the 21% VAT will be automatically deducted at checkout. However, you remain solely responsible for any applicable customs duties, import taxes, and local fees levied by your destination country.

5. Shipping and Delivery

We are responsible for the packing and handling of artworks. Shipping costs are calculated at checkout or provided upon request, depending on the destination and the nature of the artwork. All shipments are fully insured by BF4 Gallery. We assume full responsibility for any loss or damage to the artwork during transit until it is delivered to your provided address.

For international shipments, we will provide necessary documentation, but you are responsible for clearing customs and paying any specific import duties.

6. Returns and Cancellations (EU Right of Withdrawal)

If you are a consumer based in the European Union, you have the right to cancel your order and return the item within 14 days of receiving it, for any reason.

• Notification: You must notify us of your decision to return the item within the 14-day period by emailing info@bf4gallery.com.
• Return Shipping: You are responsible for the cost of returning the item to us. The item must be returned in the same condition as received, packed securely in its original packaging.
• Refund: Once we receive and inspect the item, we will refund the purchase price (including standard initial delivery costs, if applicable) within 14 days. We may deduct value for any damage caused by your handling of the item.

Exclusions: This right of withdrawal does not apply to items that are made to order or clearly personalized.

7. Authenticity Warranty

BF4 Gallery guarantees the authenticity of all artworks we sell. If an item is proven to be inauthentic by a recognized expert authority within 1 year of the sale date, we will cancel the sale and refund the full purchase price, provided the item is returned to us in the same condition.

8. Disclaimer of Warranties; Limitation of Liability

EXCEPT FOR THE AUTHENTICITY WARRANTY EXPRESSLY STATED ABOVE, ITEMS ARE PROVIDED "AS IS". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED.

OUR LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF OUR SERVICES SHALL BE LIMITED TO THE TOTAL AMOUNT YOU PAID US FOR THE TRANSACTION GIVING RISE TO THE CLAIM. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Spain.

Online Dispute Resolution (ODR): Pursuant to Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a platform for online dispute resolution, which you can find at: https://ec.europa.eu/consumers/odr/

Any dispute arising out of or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain. If you are a consumer in the EU, you may also have the right to bring a claim in the courts of your country of residence.
